Can A "Protected Class" Employee Be Terminated?

Employers are free to fire workers who happen to be in a protected class. However, according to labor attorneys, you must be able to show that you did not fire someone "because of" his or her protected class. You need evidence of a legitimate, business reason for the termination. Different reasons will require different documentation.
If you're firing for general poor performance, like inadequate productivity, you should have documentation of progressive discipline, including written warnings (signed by the employee) and perhaps a performance-improvement plan. You'll want to have a list of productivity goals and results for the employee as compared with others in the same position.
Since it is difficult to justify terminating someone for poor performance when evaluations all say "satisfactory," you should have performance evaluations that reference poor productivity. And at the time of termination, the employee would be told that the termination was because of poor performance.
If you're laying off an employee because of reorganization, you should document the business reasons such as financial reports showing a decrease in business volume or a decrease in need for a particular administrative support function. Also have explanations why other employees were not selected for layoff, such as an evaluation demonstrating the employee remaining had a broader skill set or was a better team player.

Personal Guarantee Insurance Now Available

As business owners know, most can't get loans and lines of credit even for corporations without making a personal guarantee that the money will be repaid. That requirement has stopped more than one would-be entrepreneur from pursuing a business dream. And for owners of existing companies, they forgo growth if they don't want to sign a personal guarantee.
Now there is Asterisk Financial, a personal guarantee insurance for small business owners, to protect them from losing everything if a business falters. Here's how it works: Owners of small to mid-size businesses or commercial real estate projects can buy an annual policy that will cover 30% to 70% of their net liability for loans of $500,000 to $8 million. The premium depends on the business’ credit worthiness and can be as low as 1% of the loan value. The policy beneficiaries are the owners of the business.

Original Positive-Attitude Book Highly Relevant Today!

Many of us have read Napoleon Hill's classic book, Think and Grow Rich. But before Hill, a man by the name of Orison Swett Marden published a book in 1908 titled He Can Who Thinks He Can.
Here are some of the quotes from Marden’s book written in 1908.
♦ Self-reliance is the best capital in the world. Self-depreciation is a crime.
♦ The greatest enemies of achievement are fear, doubt and vacillation.
♦ Every child should be taught to expect success.
The man who has learned the art of seeing things, looks with his brain.
♦ The best-educated people are those who are always learning, always absorbing knowledge from every possible source, and at every opportunity.
♦ People do not realize the immense value of utilizing spare minutes.
♦ Be yourself.
♦ Your judgment is your best friend; your common sense is your great life partner.
♦ Do not stop dreaming.
♦ A test of the quality of the individual is the spirit in which he does his work.
♦ Some people never see any beauty anywhere. Others see it everywhere.
♦ Your life work is your statue.
♦ Some of the greatest men in history never discovered themselves until they lost everything but their pluck and grit.
♦ Responsibility is a great power developer.
♦ If one is so loosely attached to his occupation that he can be easily induced to give it up, you may be sure that he is not in the right place.
